    So far, this is not a complex complaint. The test of this will be whether or not the respondent seeks further retribution and what an investigation reveals about the reasons and frequency of similar offenses.

    On 11/27/24 Ms. Vanags sent–she has admitted as such — a person to my home to criminally trespass. In addition, the pair sought to, and indeed completed the following: eavesdropping, taking photos and videos without permission, engaging in a cover-up (e.g., refusing to identify the on-site offender), harassment, possibly lying to police (again, refusal to identify why and who), mischaracterizing this vendor as a State Farm employee, and violating State Farm’s own privacy policy(ies).

    Still, now, six days after the incident, Ms. Vanags and her colleague Karla Capoferri have refused to explain why this occurred and who the onsite offender is. They refuse to apologize and confirm it will not happen again.


    Section 10-1-101 – Legislative declaration

    The general assembly finds and declares that the purpose of this title is to promote the public welfare by regulating insurance to the end that insurance rates shall not be excessive, inadequate, or unfairly discriminatory, to give consumers thereof the greatest choice of policies at the most reasonable cost possible, to permit and encourage open competition between insurers on a sound financial basis, and to avoid regulation of insurance rates except under circumstances specifically authorized under the provisions of this title. Such policy requires that all persons having to do with insurance services to the public be at all times actuated by good faith in everything pertaining thereto, abstain from deceptive or misleading practices, and keep, observe, and practice the principles of law and equity in all matters pertaining to such business.

    (11) “Insurable interest in property” means every interest in property or any relation thereto, or liability in respect thereof, of such a nature that a contemplated peril might directly damnify the insured.(12) “Insurance” means a contract whereby one, for consideration, undertakes to indemnify another or to pay a specified or ascertainable amount or benefit upon determinable risk contingencies, and includes annuities.(13) “Insurer” means every person engaged as principal, indemnitor, surety, or contractor in the business of making contracts of insurance.

    (19) “Transact” as applied to insurance means and includes any of the following:(a) Solicitation and inducement;(b) Negotiations preliminary to effectuation of a contract of insurance;(c) Execution of a contract of insurance;(d) Transaction of matters subsequent to effectuation of a contract of insurance and arising out of the contract obligations.

    Applicable Statutes

    Colo. Rev. Stat. § 10-1-128 – fraudulent insurance acts

    (a) Misrepresentations and false advertising of insurance policies: Making, issuing, circulating, or causing to be made, issued, or circulated, any estimate, circular, statement, sales presentation, omission, or comparison which: (I) Misrepresents the benefits, advantages, conditions, or terms of any insurance policy; or

    (IX) Misrepresentation shall not be construed where a written comparison of policies is made factually disclosing relevant features and benefits for which the policy is issued and by which an informed decision can be made;

    (c) Defamation: Making, publishing, disseminating, or circulating, directly or indirectly, or aiding, abetting, or encouraging the making, publishing, disseminating, or circulating of any oral or written statement or any pamphlet, circular, article, or literature which is false, or maliciously critical, or derogatory to the financial condition of any person, and which is calculated to injure such person;(d) Boycott, coercion, and intimidation: Entering into any agreement to commit, or by any concerted action committing, any act of boycott, coercion, or intimidation resulting in or tending to result in unreasonable restraint of, or monopoly in, the business of insurance;

    Colo. Rev. Stat. § 10-3-1104

    (XIV) Making or permitting any unfair discrimination between individuals or risks of the same class and of essentially the same hazard by refusing to insure, refusing to renew, canceling, or limiting the amount of insurance coverage on a property and casualty risk solely because of the geographic location of the risk, unless the action is the result of the application of sound underwriting and actuarial principles related to actual or reasonably anticipated loss experience; Colo. Rev. Stat. § 10-3-1104

    Whenever the commissioner has reason to believe that any person has been engaged or is engaging in this state in any unfair method of competition or any unfair or deceptive act or practice, whether defined or reasonably implied in this part 11, or has violated any other provision of this title or any rule or lawful order of the commissioner and that a proceeding by the commissioner in respect thereto would be to the interest of the public, the commissioner shall proceed as provided in article 4 of title 24, C.R.S. Any final action by the commissioner pursuant to this section shall be subject to judicial review by the court of appeals pursuant to section 24-4-106 (11), C.R.S. Colo. Rev. Stat. § 10-3-1107

    (e) Either knowingly or recklessly makes a false representation as to the characteristics, ingredients, uses, benefits, alterations, or quantities of goods, food, services, or property or a false representation as to the sponsorship, approval, status, affiliation, or connection of a person therewith;” Colo. Rev. Stat. § 6-1-105

    Section 18-4-504 – Third degree criminal trespass(1) A person commits the crime of third degree criminal trespass if such person unlawfully enters or remains in or upon premises of another.(2) Third degree criminal trespass is a petty offense, but: (a) Repealed.(b) It is a class 5 felony if the person trespasses on premises classified as agricultural land with the intent to commit a felony thereon; except that it is a class 6 felony if the agricultural land did not have a fence securing the perimeter.

    Gosh, I hope I don’t use up that title on WordPress.

    This is a brilliant move by Joe Biden. Fuck Trump and Russia at the same time!

    I don’t fault (as if it matters) Joe Biden for the border(s). Gutsy and someone had to do it. Pundit Michael Moore said, if you can stomach him, Americans don’t like immigrants, we are all immigrants. It is hard as always to be spot on. Most current immigrants are hardworking and good for the economy and country. Look at all those countries (e.g., Germany and Japan) with effete, aging workforces and taxpayers. I don’t know why, except pure economics–it’ll come back–the student loan forgiveness. He showed a lot of guts again on harmless, social acceptance norms that are more difficult and a waste of time to combat. You cannot stop the clock and he had the sense to call it quits because he wasn’t going to beat Trump. Joe Biden was a good President and we still have two months left.

    So I’m watching again. Mobile nuclear resistant bomb shelters! As they used to say on Laugh-In!, sock it to ’em.

    If you want to get real hits on YouTube this is how you do it: Russia is furious. So nice I had to record it for my new Ukraine war loop. My God, these guys are good; Nick Patton Walsh, it is visible in the film, the commentary, and the completely new world he is revealing. Storm Shadow missiles flying over (the sound) and hitting inside Russia. Sure, it is this podunk area of the country already invaded by Ukraine (or nearby), but it is still Russia. Wait, wait, I know Storm Shadows are British; the Brits have balls (pardon me, women, and everyone in between). It was followed by ATACMS.

    Now, Zelensky is on again, or still; 1,000 days. “We don’t announce. The missiles will speak for themselves.”

    You want to fight NATO? You will be destroyed. We’re safe in the United States.

    Brilliant.

    Normally I look to DW or Sky News or even France 24. CNN is killing it. The U.S. is finally speaking for ourselves.

    They’re actually interviewing a Congressman here in Colorado. Rather, I think he is in Washington. Still. I have never heard of him, until now.

    Trump? One of the reasons Harris lost is Biden is unpopular. We’re going to have four new years of that. But it was legit.

    Ben Hodges, Konstantin Eggert is on now. “How much is real” he is asked. Response: “Nothing is real.” Every supposed escalation only makes Putin and Russia look more stupid. Now he is betting his reputation or whatever remains of it! These people are so experienced at this that they are letting down their guard.

    The thing about screwing Trump at the same time has come up. Oh no! And old video of The World View from France is on now. One thing we have learned is that France is OK but is more frosting than cake; they’re pretty useless–they have nuclear weapons–in today’s world. They’re not inarticulate in English and they offer some socialist or publishable views, but it is basically literature.

    It is apparent that the U.S. knew about the Kursk incursion. Now it is ATACMS on Russian and North Korean soldiers in Russia. Wow.

    Mr. Eggert, it is not even his native tongue. They like him too. This is serious stuff. Everyone is joking and smiling.

    I cannot help myself. What do Francois and the rest have to say about the missiles. It is still on; these are long programs (43+ minutes by today’s standards). The French have style.

    YOU GO GIRL is the best comment I have ever seen on YouTube. The LIKES were spinning in the few minutes I was watching. It was so clear to most of us five or six or seven years ago. Now he is degenerating like a sick animal.

    I don’t even care if everyone in the White House is LGBTQ and a player in the WNBA. There are checks and balances. And that very well may be the price of progress.

    The momentum is so logical and American. I tend to avoid predicting even on my college football blog. Let’s hope our long national nightmare is over, again.

    The floods in Spain were just another news event at the start. Then we saw how it didn’t just dry the next day and get cleaned-up. It didn’t take long for the videos and virtually live views; the personal stories backed-up the neck-high rapids where there were no rivers and the banks and the lagoons flooding where water existed. It is a low-lying area with a warm moisture and hard, hot soil. Then the rain came.

    American National

    Sept 12 filed claim. Thursday. I asked and was told, employee adjuster. My policy does not provide for an “independent” adjuster; it uses the word “we” which means American National employee.

    This problem began to be revealed when I started receiving texts and calls from people impersonating an American National insurance adjuster. I made a homeowners claim on Sept 12. Unknown to me, I received the first the next day and then more on Sunday. I discovered them the middle of the next week and responded. Finally I had to tell the person–please, no texts. I called, no answer, and no reply.

    Then I started receiving email from a gmail account marked as a probable scam. I could no records for an insurance adjuster, licensed or not, or any existence at all for this person on the internet. I notified Mr. Anthony Britton (with effort). Some time later, I received word from Mr. Britton that this person is my adjuster and I am to communicate with him electronically. Weeks later, I never heard from him or anyone else and I received a letter with Mr. Britton’s name; I must call or email immediately. I spent hours trying to do so. Again I was informed this person is my adjuster.

    I asked again for someone from American National per my policy. A man who promised to get back to me and never did said “We don’t have anyone.” When I first made the claim I asked this too and was told I would be contacted by an American National employee as adjuster. Since then I have repeatedly asked Mr. Britton not to give my information, meaning everything, to anyone outside American National. This is not allowed per my policy, communicating with these suspicious people is not required, and this policy is to be serviced by “we, ” meaning American National employees or a supervised, vetted, and subject to American National policies, security, and communications standards person.

    While my cooperation with such a person is not required per the policy, I have allowed it to happen and have tried hard to make it work. My residence has always been available to these vendors and they have failed to show for numerous appointments. I have repeatedly communicated that M-F 9-5 is available for weeks. Neither Mr. Britton, anyone else, or even a drone has made an effort. Mr. Britton has been copied on emails and has refused to supervise the contractors or confirm an appointment. It has become so difficult that even volunteered to take pictures myself, even though my policy says nothing about pictures. The home and the roof is there to see and I cannot hide it.

    Now Mr. Britton accuses me of failing to make an inspection available to “we,” meaning American National. American National needs to do it as soon as possible.

    I encourage American National and/or Mr. Britton to review every text, phone call, letter, and email sent or received by me during this policy service request. Everything I describe here and more is documented.

    In summary, I ask again that American National enforce and service the policy. Should they require outside contractors, they must be supervised and comply with the terms of the contract also.

    Remembering Dick Cerri.

    Damn it isn’t on the few lodged cd’s in the big black Mercedes. Two minutes sitting down and retrieving solved the problem. It is with this that I sat over twenty years ago in Beaufort, SC on an endless loop.

    It was the best song I had for the still-amazing sound system. I’m too lazy to replace the discs. It is this ephemeral notion of personification. And then, it just makes me wonder, how can anyone create something so perfect?

    My God, it has been almost 25 years. If you ever wish for things that are only in the past just remember that the wrong things aren’t supposed to last.

    What happened in that parking lot in Beaufort, SC is a longer story.

  • The Kursk Invasion

    This is The West, as they say, and everyone has an opinion still after two and a half years. How easy it is to open a YouTube or Telegram channel and claim to be an expert. Ahhh, to be an influencer.

    But there are influences and there are influences. The experts, see below, are the ones worth paying attention to. Using the term loosely, everyone agrees it is masterful both in its thinking and execution. Most agree Ukraine has stolen the key ingredient of momentum even with the eventual near-capture of Pokrovsk. There has been much conjecture on the risks and potential benefits to Ukraine and this is where the overall judgement of the attack is either praised or condemned.

    It is still too early to tell given Ukraine has continued with the attack–drones on Moscow, fire in Roskov, drone attacks on airfields, and solidification without major reprisal in Kursk.

    We have been hearing about it for months and this is why and how the Russian invasion is so hard to stop; Pokrovsk and the surrounding area, railways, highways, and supply routes, may fall. If so, it will be destroyed like Mariupol and other places; no more citizen attacks like Bucha. Blame it on The West, some say, meaning the United States. Regardless, that is how they–Russians–do it and the Ukrainians know it better than anyone. Destroy it completely and rebuild it as our own. Perhaps even Ukraine’s best soldiers and (local) equipment cannot stop it.

    Out of survival and desperation, Ukraine, on its own, chose to attack. Call it a loophole in terms of using donated weapons. We have learned from Putin that there is constant embarrassment, but above all he survives. Analysis tells us that as long as they can continue the attack and momentum in some way it is a wise move. Why did they go out in the open and lose men and equipment in Russia? They had to. It is still a smart move until it isn’t.

    There are some macro influences working in Ukraine’s favor, such as Russia’s economy, demographics, Russian losses, and Europe’s efforts. Then there are oligarchs, corruption, and bureaucracy.

    Could it be another fall of the Soviet Union or election of another Yeltsin or Gorbachev? No, there is no indication Putin has lost control. But among all the analysis centered on Ukraine’s objectives, they are claiming and proving the fact that Russia is not as invincible–as dangerous–as previously thought. They are vulnerable if not beatable, especially by NATO or the U.S.

    Crux, or at least the video in the screenshot above, is not particularly helpful; this is, and it is still relevant today; so is this. Most memorable is the statement from Mireille Clapot, the Member of French Parliament, when she qualifies all the information as “everything Putin says is a lie” (paraphrasing). The information coming from Ukraine is better but, in war and even from civilians and journalists, it is still lacking. We rely on us/the analysts and pundits as the best input available.

    Russia is an “information autocracy” and Putin is on walkabout. Sean Bell (Sky and elsewhere) said it too: warfare is all about momentum and initiative.

    The Crux headline is the headline news today because Putin has a very, very serious problem. The real news is the Ukrainian momentum and initiative is continuing with a major strategic missile strike near Crimea, continued drone attacks on airfields in Russia, and evacuations, threats, or incursion in Kursk, Belgorod, and Bryansk oblasts.

    Oh, not to be an influencer.

    It is all good news in a subtle, French kind of way. The U.S. policy has been great with a blip so far; yes we want to degrade Russia so they can’t do it again but no, we are not in the nation-destroying or leader-assassinating business.

    Ukraine, for all their complaining, has been a country who deserves their independence. They sank the railroad car ship near the Kerch bridge with their own Neptune missile and Ukrainians developed, built, and flew the drones that destroyed Russian fighter jets and oil installations. They are industrious (read: capitalist), democratic, and the best possible defense for Europe and the West.

    Obviously, Russia is not going to win as long as Ukrainian soldiers are in their country. So right now, Ukraine is winning.
