Ultimately, the trust distribution rules a trustee must abide by will come down to the terms of the trust. Unless trust provisions expressly authorize the trustee to use their discretion when making distributions of trust assets to beneficiaries, their straying from the terms of the trust is considered a breach of duty for which they could potentially face trustee removal and/or a surcharge. link
